SO. Let's say I'm charged with murder. The state says that I murdered my friend Ted.
I go on trial for murder.
The prosecution says that they found Ted's body. And it was completely decomposed. So badly decomposed that the medical examiner could not determine a cause of death. The bones had been scattered about.
The guy that found Ted's body first says that Ted's head was in a bag. Then he says that Ted's head was not in a bag. Then he admits that he poked Ted's skull with a stick. Then he says that he actually found Ted's body three months ago, but no one else found it then, so now he found it again.
So the prosecution says that when the crime scene investigators got to the scene of the crime, there was duct tape over Ted's mouth and nose, which is evidence that I used duct tape to suffocate Ted.
But that makes no sense.
First of all - this other guy has been playing around with Ted's body and poking sticks at the skull.
But just think about it... if I were to use duct tape to suffocate you,
leave the duct tape on your body
and then I dumped your body
where it decayed for 6 months in 100 degree heat
and by the time your body was found
the bones had been scattered by animals
and by a guy poking it with his stick
and by rain
and by other garbage
and by hurricane winds
and everything was gone
And it's been 6 months, so your body is totally decayed.
you had no nose
Do you think the duct tape would still be laying perfectly over your nose and mouth? Your nose and mouth that don't even exist anymore?
