Here are my thoughts so far -
- I'll be fine when it's 9-12:30. But this week it's 9-3. And coming back after lunch was BRUTAL.
- To the fellow bar/bri students who got on the same bus as me after class and were talking SO LOUDLY about specific freaking problems that we did today that I could hear you OVER MY IPOD: Get a damn life. In the words of my dear friend:
"talking about practice problems on Day 1? Go to fucking hell."
- No doubt the worst part about this summer is going to be listening to all these other freaking dorks talk about how much they're studying. kill me.
- There were a couple of problems about "larceny by trick" during the criminal law questions. Uhhh.... I have NEVER heard of larceny by trick in my entire life. I thought it was a joke. Surely I would remember if I had heard of LARCENY BY TRICK, right? And of course the whole time the lady is going over the problems I chuckle every damn time she says "trick."
Soo yeah, obviously I've got a little bit of work to do this summer.

OMG, hahaha during that first practice test, I totally thought they included Larceny By Trick as ...well, as a trick! I thought for sure it wasn't real. What the eff was my law school doing not teaching my such important things!!???

ReplyDeleteI remember some douchey guy who was not only bragging about how well he did on each test, but also about his final class ranking. I kind of hoped he got hit by a bus. Just remember that the people who know everything this week will not study and might just fail in July. Fuck those guys. Fail in a blaze of glory this week and then you know what to work on. Or something. And laugh at Dottie every time she does her A-B-A-B-A-B-A-B-EH! WRONG schtick.

ReplyDeleteI am in the same boat with the larceny by trick thing. The first time I heard it was from barbri and I thought it had to be a joke. Definitely one of the few things I would have remembered from first year! Maybe it's a joke barbri is playing on us. Seeing what ridiculous things they can make us believe are actually laws? Good luck studying!
ReplyDeleteI just finished my first year of law school and my prof had it in his "handouts" aka his outline that he gave us. Here's how he defined it:
ReplyDeleteLarceny by Trick – one who obtains possession with the owner’s consent, but by written or spoken misrepresentation does not gain lawful possession and is guilty of larceny. The owner retains constructive possession.

my 1L crim law prof covered larceny by trick, but skipped insanity defenses. M'Naghten rule!?! never heard of it before today's practice questions.
